1. Introduction
This Privacy Policy explains how Pacer Health, Inc. ("Pacer," "we," "us," or "our") collects, uses, stores, protects, and shares Personal Data when you use the Pacer mobile applications for iOS and Android, Pacer for Teams, the mypacer.com website and its subdomains, and related products, features, and services (collectively, the "Services").
By accessing or using the Services, you acknowledge that you have read this Privacy Policy. If you do not agree with this Privacy Policy or our Terms of Service, do not use the Services or provide Personal Data to us. This Privacy Policy is provided in English.
We may update this Privacy Policy as the Services or applicable requirements change. We will post the updated policy in the Mobile App and on the Website and provide prominent notice of material changes where required.
2. Important Notice Regarding Health Services
Pacer can connect with Apple Health, Health Connect, and other third-party fitness, health, and tracking applications and services (collectively, "Health Services"). Connecting a Health Service is optional. Pacer cannot read data from or write data to a Health Service unless you choose to connect it and grant the requested permissions.
Depending on the Health Service and permissions you grant, Pacer may read or write activity, exercise, health, or wellness information needed for the connected feature. If data originating from Fitbit or Google Health appears in Pacer, it is received through Apple Health or Health Connect after you authorize the applicable platform and grant Pacer the requested permissions. Pacer does not connect directly to Fitbit or Google Health through their APIs.
You can withdraw a Health Service permission through the applicable Health Service or, where available, through Pacer settings. Data already imported into Pacer or previously written to a Health Service may not be deleted merely because you disconnect. See Section 14.
Pacer uses Health Service data only to provide, maintain, secure, and improve the health and fitness functionality that you choose to use. Pacer does not sell Health Service data or use it for advertising, retargeting, or personalized marketing. Information stored by a third-party Health Service is governed by that provider's privacy policy and terms.
3. Important Notice Regarding Third-Party APIs and AI
Pacer may use third-party APIs to provide specific features, such as processing text that you choose to submit to an AI-enabled feature. Pacer does not intentionally send your name, Pacer account credentials, or email address to an AI provider for that processing.
Health Service data, Health Service identifiers, authorization tokens, and synchronization metadata are excluded from AI-provider processing unless Pacer first determines that the transfer is permitted by applicable law and platform policies, clearly discloses the provider and purpose, and obtains any required consent.
Third-party providers process information under their own applicable terms and privacy commitments.
4. International Data Transfers
The Services are hosted on servers in the United States. If you use the Services from another country or region, your Personal Data may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your place of residence. Where applicable law requires a particular legal mechanism or safeguard for an international transfer, Pacer will rely on that mechanism or safeguard rather than consent alone.
5. Information We Collect
5.1 Account, Profile, and Contact Information
We collect information used to create, secure, and operate your account, such as your display name, email address, password, year of birth or birthdate where needed, profile picture, profile description, and country or region. If you purchase a physical item or contact us, we collect information needed for fulfillment or support.
5.2 Fitness and Wellness Data
We collect fitness and wellness information that you provide or generate through the Services, such as fitness habits and goals, weight, body mass index, height, gender, blood pressure, heart rate, step length, daily activity, and exercise sessions. Supported device sensors may provide step counts, accelerometer and barometer readings, GPS coordinates, timestamps, elevation, speed, and bearing.
5.3 Data from Devices, Health Services, and Third-Party Accounts
If you connect a device, Apple Health, Health Connect, or another supported service, Pacer receives the data and identifiers that you authorize and that are needed for the integration. If data originates from Fitbit or Google Health, Pacer receives it only through Apple Health or Health Connect; Pacer does not connect directly to Fitbit or Google Health.
If you use a third-party account, such as Apple, Google, or Facebook, to log in to Pacer, we receive the account information that you authorize the provider to share, such as your name, email address, or account identifier.
5.4 Location Data
We process location information when needed for location-based features that you choose to use, such as recording an outdoor GPS exercise session. By default, Pacer does not track your location when it is not needed for an enabled feature.
5.5 Content You Share
We collect photos, posts, comments, likes, ratings, routes, reviews, check-ins, and other content that you submit. Visibility depends on your profile and sharing settings and the feature you use.
5.6 Contacts and Friends Lists
With your explicit permission, Pacer may access device contacts or a supported social-network friend list to help you find people you know. Pacer does not retain device contact information on its servers unless a feature expressly tells you otherwise.
5.7 Payment and Transaction Information
Pacer and its payment providers process transaction details needed to complete purchases. Pacer does not store your full payment-card number.
5.8 Technical Information and Logs
We collect technical information needed to operate, protect, diagnose, and improve the Services, including IP address, browser and app information, device identifiers, timestamps, locale, performance measurements, errors, crashes, security events, synchronization status, and product-usage events.
5.9 Other Information
We may collect information that you voluntarily provide through surveys, research, promotions, feedback, customer support, or other interactions. We will provide additional notice or obtain consent where required.
6. How We Use Information
We use Personal Data to provide activity tracking, exercise recording, trends, reports, programs, challenges, community features, and Pacer for Teams; personalize features and make recommendations subject to the permissions and purposes described in this Privacy Policy; secure accounts and prevent fraud and abuse; troubleshoot, maintain, test, analyze, and improve the Services; respond to inquiries; send transactional messages and consented marketing; process subscriptions and purchases; comply with legal obligations; and create aggregated or de-identified information where permitted.
Pacer may use aggregated or de-identified information for benchmarks, product insights, and route discovery. Pacer does not use Health Service data, including derived or de-identified Health Service data, for broader aggregation purposes unless the use is part of a clearly disclosed, user-facing health or fitness feature and permitted by applicable law and platform policies.
8. Legal Bases for Processing
Where applicable law requires a legal basis, Pacer relies on performance of a contract, consent, legitimate interests that are not overridden by your rights, and legal obligations.
9. Your Choices and Privacy Rights
Depending on where you live, you may have rights to access, correct, receive a copy of, restrict or object to processing of, withdraw consent for, or delete Personal Data. You can manage many choices through Pacer settings, device settings, connected-service settings, and communication unsubscribe controls. We may need to verify your identity before fulfilling a request.
10. Children
You must be at least 16 years old to use the Services. Pacer does not knowingly collect Personal Data from anyone under 16.
11. Security
Pacer uses administrative, technical, and organizational safeguards appropriate to the nature and sensitivity of Personal Data, including encryption in transit, encryption at rest for sensitive stored data, access controls, least-privilege service accounts, authentication protections, logging and monitoring, backup protections, vulnerability management, and incident-response procedures. No method of transmission or storage can eliminate every risk.
12. International Users
Privacy and consumer-protection rights vary by location. Pacer will provide region-specific notices or mechanisms where required. Nothing in this Privacy Policy limits rights that cannot lawfully be waived.
13. Third-Party Services and Links
The Services may link to or integrate with services operated by others. Their collection and handling of information is governed by their own privacy policies and terms. Pacer is not responsible for a third party's independent privacy practices, but remains responsible for Pacer's own transfers and disclosures described in this Privacy Policy.
14. Data Retention, Disconnection, and Deletion
Pacer generally retains account and profile information while your account remains active; activity, exercise, and wellness data until you delete it or it is no longer needed; transaction records for periods required by law; and security, fraud-prevention, support, and technical records for limited periods needed for those purposes.
When data is deleted from active systems, residual copies may remain temporarily in encrypted backups. You may delete data or request account deletion through Pacer settings. Confirmed deletion requests will be completed within 30 days, except for limited retention required by law or reasonably necessary for security, fraud prevention, dispute resolution, or enforcing agreements.
Disconnecting a third-party service stops future exchanges after the request is processed but does not necessarily delete copies already held by Pacer or the third party. You can delete Pacer-stored data through applicable Pacer controls or by requesting account deletion.
15. Changes to This Privacy Policy
We may revise this Privacy Policy from time to time. The effective date at the top identifies the current version. If a change materially affects how we collect, use, or share Personal Data, we will provide prominent notice and obtain consent where required before the change applies.
16. Contacting Us
Pacer Health, Inc. is the controller of Personal Data described in this Privacy Policy unless a separate notice identifies another controller.
